Cybernet Communications
will maintain the installed Internet access for all
its business clients to provide them the best performance
when accessing the Internet. To achieve this goal,
Cybernet Communications guarantees the following to
it's Business clients using Dialup 56k, ISDN, High-Speed
ADSL and T1 services.
Should Internet access service become
unavailable for more than 4 hours, measured between
7 a.m. and 9 p.m. every day, affected client will
receive a credit. That credit will be equivalent,
for each four (4) hour period of unavailability during
that month, to one day of service charges due that
month for the service affected. |

99.99% uptime guarantee limitations: |

This guarantee does
not cover service interruptions caused by equipment
failure or events which are not the direct responsibility
of Cybernet's personnel. This guarantee does not cover
service interruptions due to scheduled maintenance
which will be announced in advance to all the potentially
affected customers, or will it be for emergency network
maintenance or for events associated with customer
service activations.
This guarantee does not cover service
interruptions for residential plans used for business.
Credits granted under this guarantee
for the unavailability of services for a given month
will not exceed 50 % of the total monthly expenses
charged for this month for the affected service. |

Web Hosting service guarantee |

If your web site downtime
is more than a cumulative .72 hours per month, we
will credit the amount of downtime over .72 hours
to your next hosting fees. Downtime is referred to
as our network equipment being down. We do not possess
control over the Internet, therefore we cannot guarantee
that you will be able to access your site due to circumstances
beyond our control. We guarantee that our network
will be up and functioning 99.99% of the time per
month. We feel a safety net of .01% each month allows
us time for repairs and unforeseen events that may
arise.
In order for you to receive a credit on your account,
you must request such credit within ten (10) days
after you experienced the down time. You must request
credit by sending an electronic mail message to accounts@mycybernet.net.
For security, the body of this message must contain
your account number, the dates and times of the unavailability
of your website, and such other customer identification
required by Cybernet Communications Inc.. Credits
will usually be applied within (30) days of your credit
request. Credit to your account shall be your sole
and exclusive remedy in the event of an outage.

Credits shall not be
provided to you in the event that you have any outage
resulting from
(1) scheduled maintenance which will
be announced in advance to all the potentially affected
customers.
(2) your behavior or the performance or failure of
your equipment, facilities or applications, or
(3) circumstances beyond Cybernet Communications Inc.
reasonable control, including, without limitation,
acts of any governmental body, war, insurrection,
sabotage, embargo, fire, flood, strike or other labor
disturbance, interruption of or delay in transportation,
unavailability of interruption or delay in telecommunications
or third party services, including DNS propagation,
domain name registration / transfer, failure of third
party software or hardware or inability to obtain
raw materials, supplies, or power used in or equipment
needed for provision of your web site, or
(4) a client breaking any item in Cybernet Communications
Inc. "terms of conditions and acceptable use
policy" causing a server to fail as a result.

Day Money Back Guarantee |

Each
of our web hosting plans carries a 30 day Money Back
Guarantee. If you are not completely satisfied with
our services within the first 30 days of your contract,
you will be given a full refund of the contract amount
excluding setup fees, domain processing fees and overages.
This
policy does not apply to any additional services such
as overages, disk space, extras, etc. All cancellations
must be received in writing as per the deadlines indicated;
regular mail, e-mail and fax notifications are acceptable.
Phone requests will not constitute acceptance of any
cancellation.
